These Terms & Conditions apply to the supply and installation of window furnishing products and related services provided by Melbourne Window Furnishing ("MWF", "we", "us" or "our").
By accepting a quotation, placing an order, making a payment or otherwise engaging MWF to supply products or services, you agree to these Terms & Conditions, subject to any specific terms contained in your quotation, order confirmation or written agreement with us.
Where there is any inconsistency between these Terms & Conditions and a specific written agreement signed by both parties, the specific written agreement will apply to the extent of the inconsistency.
MWF supplies and, where applicable, installs custom-made window furnishing products, including:
Product specifications, materials, colours, dimensions, quantities, operation methods and installation requirements will be set out in the quotation, order confirmation, measure and/or other documentation provided to the customer.
All quotations are based on the information available to MWF at the time the quotation is prepared.
Unless otherwise stated in writing:
A quotation does not constitute an accepted order until the quotation has been accepted and any required deposit or payment has been received.
MWF reserves the right to correct genuine pricing or typographical errors in quotations prior to acceptance.
At Melbourne Window Furnishing, we are committed to offering competitive pricing without compromising on quality.
If you receive a genuine comparable quotation from another supplier, we are happy to match it — and where possible, beat it.*
To qualify, the competing quotation must be genuine, current and verifiable, and must include the same products, fabrics, components, specifications, quantities, warranties and installation requirements as quoted by Melbourne Window Furnishing.
*Any price reduction or price beat is subject to our review and discretion, and may not be available where the competing quotation is based on different products, specifications, inferior components, promotional pricing, clearance stock, or other terms that are not directly comparable.
Simply provide us with the competing quotation and we will be happy to review it.
Melbourne Window Furnishing is pleased to offer free quotations throughout Melbourne.
Free on-site measuring and quotation services are available for properties located within 20 km of our Epping base.
For properties outside this 20 km service area, a travel and/or site visit fee may apply. Where a fee is charged, the applicable amount will be advised prior to the appointment and, where applicable, credited towards the customer's final order.
Customers outside our free on-site service area can also receive a free quotation remotely by providing a suitable floor plan, measurements and/or relevant project information. Where sufficient information is provided, MWF can prepare an itemised quotation with measurements and pricing marked up against the customer's floor plan.
Additional travel or site visit fees may also apply where a project requires multiple site visits, return visits or travel outside our standard service area.
An order becomes binding once the customer has accepted the quotation and MWF has received any required deposit or payment.
Because many window furnishing products are custom manufactured to the customer's measurements and specifications, orders may be placed with suppliers shortly after acceptance.
Once manufacturing has commenced, cancellations, alterations or changes requested by the customer may not be possible or may result in additional costs.
Many products supplied by MWF are manufactured specifically for the customer's property and measurements.
Custom-made products may not be eligible for cancellation, return or exchange merely because the customer changes their mind, subject always to the customer's rights under the Australian Consumer Law.
Minor variations in colour, texture, weave, finish, grain, pattern, dimensions and appearance may occur due to:
These variations will not necessarily constitute a defect.
Where an exact colour, finish or appearance is critical, customers should inspect a physical sample before placing an order.
Customers are responsible for approving their final selection of fabric, colour, finish, hardware and other visible product specifications before manufacture.
Images displayed on our website, social media, brochures or digital devices are provided as a general representation only.
Actual colours and finishes may vary depending on lighting, screen settings and manufacturing batches.
Where a customer has approved a physical sample, the sample will generally be used as the reference for the selected product, subject to reasonable manufacturing variations.
Where MWF provides a measuring service, measurements will be taken based on the conditions reasonably observable at the time of measurement.
Customers must advise MWF of any relevant circumstances that may affect the installation, including:
Where the customer supplies measurements, MWF is entitled to rely on those measurements unless otherwise agreed in writing.
The customer remains responsible for ensuring that information supplied by them is accurate.
Where installation is included, MWF will install products with reasonable care and skill.
Installation is based on the site conditions observed at the time of installation.
Additional charges may apply where installation requires work outside the agreed scope, including but not limited to:
MWF will advise the customer where additional work is identified wherever reasonably practicable before undertaking that work.
The customer must ensure that:
MWF is not responsible for delays or additional costs caused by inadequate access, unsafe conditions or failure to provide required approvals.
Window furnishings may require drilling, fixing or mounting into walls, ceilings, window frames or other surfaces.
While MWF takes reasonable care during installation, customers acknowledge that concealed services or structural conditions may not always be identifiable before drilling or fixing.
Customers must advise MWF of any known concealed electrical wiring, plumbing, structural elements or other services.
Where MWF reasonably considers a proposed fixing location unsafe or unsuitable, MWF may recommend an alternative fixing method or location.
MWF takes reasonable care during installation but cannot guarantee that existing paint, plaster, render, tiles, timber, brickwork or other surfaces will remain completely free from minor marks, cracking, chipping or other disturbance associated with drilling, fixing or removing existing furnishings.
Where an existing surface is already damaged, deteriorated, poorly adhered or unsuitable for fixing, MWF will not be responsible for damage resulting from the existing condition of that surface.
Motorised products may require access to electrical power, charging, batteries, hubs, remotes, applications, Wi-Fi, Bluetooth, Thread, Matter or other compatible systems depending on the product selected.
Unless specifically included in the quotation, MWF does not provide licensed electrical work.
Where mains electrical work is required, a suitably licensed electrician may need to be engaged.
Smart-home compatibility may depend on the customer's network, internet connection, smart-home platform, hub, firmware, manufacturer support and third-party applications.
MWF does not guarantee uninterrupted compatibility with third-party platforms or services where those services are outside MWF's control.
Customers are responsible for maintaining their internet connection, Wi-Fi network, compatible smart-home equipment and associated accounts unless otherwise agreed.
Customers should operate blinds, curtains, shutters and motorised products in accordance with the manufacturer's instructions.
Products must not be forced, overloaded, modified or operated in a manner inconsistent with their intended use.
Damage caused by misuse, accidental damage, unauthorised modification, impact, incorrect operation or failure to follow manufacturer's instructions may not be covered by a manufacturer's warranty.
Nothing in this section limits any rights the customer may have under the Australian Consumer Law.
Customers are responsible for ensuring that window furnishings are used safely and that children are supervised around cords, chains, blinds, curtains and other window furnishing components.
Where applicable, products will be installed in accordance with relevant requirements and manufacturer's installation instructions.
Customers must not modify safety devices or remove safety components supplied with a product.
Estimated lead times are provided as an indication only unless a specific completion date has been expressly agreed in writing.
Lead times may be affected by:
MWF will make reasonable efforts to keep customers informed of material delays.
A delay does not automatically entitle a customer to cancel an order or obtain compensation where the delay is caused by circumstances outside MWF's reasonable control, subject to any rights the customer has under applicable law.
The required deposit and payment schedule will be stated in the quotation or written agreement.
Unless otherwise agreed in writing, invoices are payable by the due date stated on the invoice.
MWF may require payment of the applicable deposit before ordering or commencing manufacture of custom-made products.
For commercial projects, builders, developers and other trade customers, separate payment terms may apply as stated in the quotation, purchase order or written agreement.
Where an amount remains unpaid after its due date, MWF may, subject to applicable law and the terms of the relevant agreement:
Any interest or recovery costs will only be charged where permitted by law and/or expressly agreed in the applicable contract.
To the extent permitted by law, ownership of goods supplied by MWF remains with MWF until all amounts owing for those goods have been paid in full.
Risk in products will pass in accordance with applicable law and the circumstances of delivery and installation.
Nothing in this clause is intended to exclude or limit any rights that cannot legally be excluded.
Any changes requested by the customer after acceptance of an order may constitute a variation.
Variations may include changes to:
Additional costs and/or delays resulting from a variation will be advised to the customer where reasonably practicable.
A variation may require a new quotation or written approval before work proceeds.
Customers should contact MWF as soon as possible if they wish to cancel or change an order.
Because many products are custom-made, cancellation may not be possible once products have been ordered or manufacturing has commenced.
Where cancellation is permitted, MWF may retain or charge reasonable costs already incurred, including supplier charges, manufacturing costs, freight, labour and other non-recoverable costs, subject to applicable law.
Nothing in this section limits any statutory cancellation, refund or other rights available to the customer.
Customers should notify MWF as soon as reasonably practicable if they believe a product or installation is defective or does not comply with the agreed specifications.
MWF may require reasonable information, photographs, videos or access to the property to assess the issue.
Where appropriate, MWF may arrange an inspection, repair, replacement or other remedy.
Manufacturer warranties may apply to particular products and may vary depending on the manufacturer and product.
Manufacturer warranties are additional to, and do not replace, the customer's rights under the Australian Consumer Law.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights, guarantees, remedies or obligations that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure with goods and to compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
For services, where there is a major failure, you may be entitled to cancel the service contract and obtain a refund for the unused portion, or compensation for its reduced value. Where a failure does not amount to a major failure, you may be entitled to have the service rectified within a reasonable time.
Further information about consumer guarantees is available from the Australian Competition and Consumer Commission.
Except where required by law, MWF does not provide refunds or exchanges merely because a customer changes their mind, selects the wrong colour or fabric after approval, or no longer requires a custom-made product.
This does not affect any rights available to customers under the Australian Consumer Law.
MWF is not responsible for damage caused after installation by:
This does not affect any rights the customer may have where the damage or issue is attributable to a failure by MWF to comply with its legal obligations.
MWF is not responsible for defects or deterioration in existing walls, ceilings, window frames, reveals, plaster, paintwork, electrical systems, structural elements or other building components that existed before installation.
Where existing building conditions prevent safe or proper installation, MWF may require those conditions to be rectified before installation can proceed.
If MWF attends a property and cannot reasonably complete the agreed work because of circumstances outside MWF's control, including lack of access, unsafe conditions, incorrect information, other trades or unfinished building works, a return visit or additional labour may incur a reasonable fee.
MWF will advise the customer where reasonably practicable before charging additional fees.
MWF will not be liable for delays or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, fire, flood, transport disruption, supplier failure, manufacturing disruption, industrial action, government restrictions, shortages of materials or other circumstances beyond MWF's reasonable control.
Where such circumstances occur, MWF will take reasonable steps to minimise the impact and resume performance as soon as reasonably practicable.
MWF may photograph completed installations for quality-control, portfolio, website and marketing purposes.
MWF will not intentionally publish identifying personal information about customers without appropriate permission.
Customers may request that photographs of their property not be used for marketing purposes.
MWF endeavours to ensure that information displayed on its website is accurate and current.
However, product specifications, colours, availability, pricing, lead times and manufacturer information may change without notice.
Website images are illustrative and may not accurately represent the exact colour, texture or finish of a product.
The specific quotation and product selection approved by the customer will govern the customer's order.
Unless otherwise agreed, all photographs, designs, drawings, branding, written content, graphics and other materials created or supplied by MWF remain the property of MWF or the relevant copyright owner.
Materials may not be reproduced, copied or commercially used without permission.
MWF may collect and use customer information for purposes including:
MWF will handle personal information in accordance with applicable privacy laws and its Privacy Policy.
If a customer has a concern regarding a product or service, they should first contact MWF so that we can investigate and attempt to resolve the matter.
Customers should provide reasonable details of the issue, including photographs or other information where relevant.
MWF will make reasonable efforts to resolve genuine complaints promptly and fairly.
Nothing in this clause prevents a customer from exercising any rights available under Australian law or contacting an appropriate consumer protection or dispute resolution body.
MWF may update these Terms & Conditions from time to time.
The version applicable to an order will generally be the version in effect when the order is accepted, unless otherwise agreed or required by law.
These Terms & Conditions are governed by the laws of Victoria, Australia.
The parties submit to the applicable courts and tribunals of Victoria, subject to any mandatory rights or jurisdiction available to a customer under applicable law.
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.
